-
There are a number of avenues for lodging a complaint about a real
estate agent or land valuer.
-
-
- (1) Consumer Affairs / Fair Trading / Consumer Protection
agencies
- Each State or Territory's
Consumer Affairs / Fair Trading / Consumer
Protection department
is responsible for licensing
of estate agents in that
State/Territory.
See
contact information for your state below.
(2) Australian Competition and Consumer Commission (ACCC)
The ACCC can deal with breaches of the Trade Practices Act 1974.
For example, you may think that you've been deceived or misled by a
real estate agent. For more information about the Trade Practices Act
1974 and the ACCC, click here.
"Fair and Square: A guide to
the Trade Practices Act for the real estate industry".
This publication was written for the real estate sector by the Small
Business Unit of the ACCC, in consultation with the real estate industry.
It covers familiar market situations under which the Trade Practices Act
applies to real estate agents. A useful publication for consumers also.
It's on the ACCC site here.
(3) Real Estate Institute of Australia (REIA)
The REIA has Principles of Conduct (a public statement of the ethics expected to be upheld by all REI members,
as well as the employees of those members, in their dealings with the public and other real estate practitioners).
If you have a complaint about the behaviour of a
member of the Real Estate Institute you can lodge a complaint
with your State or Territory Office of Fair Trading/Consumer Affairs. See contact information for your
state below.
The local branch of the Real Estate Institute may also be able to help.
(4) Australian Property Institute (API)
The Australian Property Institute represents property professionals throughout Australia and overseas.
API members include residential, commercial and plant and machinery valuers, property advisers, property analysts and fund
managers, property lawyers, and property researchers and academics.API's primary role is to set and maintain the
highest standards of professional practice, education, ethics and professional conduct for it members and the broader property
profession. API's Code of Professional Conduct is a public statement of the principles, values and behaviour expected of
API members. API (together with the Property Institute of New Zealand) also publishes valuation property standards.
(5) Agents
Boards (in some States and Territories).
