To complain about a real estate agent, auctioneer, or land valuer

There are a number of avenues for lodging a complaint about a real
estate agent or land valuer.

(1) Consumer Affairs / Fair Trading / Consumer Protection agencies

Each State or Territory's Consumer Affairs / Fair Trading / Consumer
Protection department is responsible for licensing of estate agents in that
State/Territory. See contact information for your state below.

(2) Australian Competition and Consumer Commission (ACCC)

The ACCC can deal with breaches of the Trade Practices Act 1974.
For example, you may think that you've been deceived or misled by a
real estate agent. For more information about the Trade Practices Act
1974 and the ACCC, click here.

"Fair and Square: A guide to the Trade Practices Act for the real estate industry".

This publication was written for the real estate sector by the Small
Business Unit of the ACCC, in consultation with the real estate industry.
It covers familiar market situations under which the Trade Practices Act
applies to real estate agents. A useful publication for consumers also.

(3) Real Estate Institute of Australia (REIA)

The REIA has Principles of Conduct (a public statement of the ethics expected to be upheld by all REI members, as well as the employees of those members, in their dealings with the public and other real estate practitioners).

If you have a complaint about the behaviour of a member of the Real Estate Institute you can lodge a complaint with your State or Territory Office of Fair Trading/Consumer Affairs. See contact information for your
state below. The local branch of the Real Estate Institute may also be able to help.

REIV's web site used to include public links to a Code of Conduct and an Auction Code of Conduct you may find useful in understanding your rights and obligations and in framing your complaint. These are in the password-protected members section so we cannot link them for you. We suggest you ring the REIV and ask for a copy.

The REINSW can reprimand , suspend, fine or expel a member,

or require additional training.

The REINSW's site includes a link to its Code of Practice (which may help you understand your rights and responsibilities) and a range of consumer fact sheets. There's nothing about how to make a complaint about a real estate agent though.
