Since 1998, all franchise
groups (such as Wendy's, Jim's Mowing, McDonalds, and
many more similar and smaller
enterprises and co-operatives) have been required
to comply with the Franchising
Code of Conduct in their dealings with franchisees.
This Code is established
under the Trade Practices (Industry Codes - Franchising) Regulations
1998.
This is not a Code for ordinary
consumers of the products of these companies.
Its focus is to help ensure
that people looking to buy a franchise
can make an informed business
decision. It deals with matters such as disclosure,
agreement conditions, cooling-off
periods, funds for marketing.
The dispute resolution procedure
is set out in Part 4.
You can access the Franchising
Code of Conduct and other useful information on franchising from the site of the Australian Competition and Consumer Commission (ACCC)'s website, here.
